Immigration Solutions to Advance Strong Cases

Adjustment of Status and Consular Processing are the two options available for family members seeking lawful permanent resident status.  Adjustment of status is an option for a family member who is lawfully in the U.S.  For all other family members seeking a family-based immigrant visa, consular processing is the method to use.  A brief overview of the two methods are below:

Adjustment of status Consular processing
  • Immediate relative files a Form I-485 application with USCIS while remaining in the U.S.
  • Approval of the I-485 grants permanent residence.
  • Qualifying family member applies for an immigrant visa at a U.S. embassy or consulate abroad.
  • After the visa is issued, the worker presents it at a U.S. port of entry and is admitted as a permanent resident.
